Terms of Service

1. Acceptance of Terms

By accessing or using GradedBazaar (the “Platform”) at gradedbazaar.com, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform. GradedBazaar is operated from Chennai, Tamil Nadu, India.

2. About the Platform

GradedBazaar is an online marketplace that facilitates transactions between buyers and sellers of graded trading cards (PSA, BGS, CGC, SGC, and similar grading authorities). We do NOT own, sell, ship, or guarantee any individual listing. We act solely as an intermediary providing escrow, payment processing, and dispute resolution services.

3. Eligibility

• You must be at least 18 years of age, or have parental consent if a minor
• You must reside in India and have a valid Indian bank account to sell
• You must provide accurate KYC information (PAN, bank details) to sell
• One account per individual. Multiple accounts will be banned

4. Seller Obligations

• You must own the card you list and have legal right to sell it
• Cards must be genuine, professionally graded by recognised graders (PSA, BGS, CGC, SGC)
• Cert numbers and grades shown in listings must match the physical slab exactly
• You must ship within 3 business days of payment via tracked courier (India Post, Delhivery, DTDC, BlueDart, etc.)
• You must update tracking information promptly in your dashboard
• You agree to pay the platform fee (8%) and applicable GST on the platform fee
• You authorise GradedBazaar to deduct TDS at 1% under Section 194-O of the Income Tax Act, 1961

5. Buyer Obligations

• Inspect the card upon arrival and confirm delivery within 7 days, or it auto-confirms
• Open a dispute within 72 hours of marking delivery if there is a genuine issue
• Pay all amounts shown at checkout in full
• Do not abuse the dispute system. Frivolous disputes may result in account suspension

6. Fees

• Seller fee: 8% of the final sale price (plus applicable GST on the fee)
• TDS: 1% of gross sale value, deducted and remitted to the Indian Income Tax Department
• Buyer premium: Currently zero. May be introduced with 30 days notice
• Payment gateway fees: Borne by GradedBazaar from the platform fee

7. Escrow and Payments

All payments are held in escrow via Razorpay (a licensed payment aggregator) until delivery is confirmed. Funds are released to the seller's balance after buyer confirmation or 7 days post-shipment, whichever is earlier. Sellers may request payouts to their registered Indian bank account; payouts are processed within 2 business days.

8. Disputes

Buyers may open a dispute within 72 hours of marking delivery for: item not received, cert mismatch, damage in transit, counterfeit slab, or other. Sellers have 5 days to respond, after which the dispute escalates to GradedBazaar admin for review. Resolution may include full refund, partial refund, or rejection of the dispute. GradedBazaar's decision is final.

9. Prohibited Conduct

You agree NOT to:

• List counterfeit, stolen, or misrepresented items
• Manipulate auctions through shill bidding (we use anti-shill scoring; violators are banned)
• Communicate with counterparties off-platform to evade fees
• Misuse the dispute system to extort sellers
• Scrape, copy, or republish listings or other Platform content
• Use bots or automated tools to bid, list, or place orders

10. Account Suspension

We may suspend or terminate accounts for violations of these Terms, fraud, repeated disputes, or risk to other users. Suspended sellers forfeit their pending balance for 90 days for chargeback protection. After 90 days, remaining balance is paid out minus any unresolved liabilities.

11. Intellectual Property

All Platform content (logo, design, code, copy) is owned by GradedBazaar. Listing photos and descriptions are licensed to GradedBazaar by sellers on a non-exclusive basis for the purpose of operating the marketplace.

12. Limitation of Liability

GradedBazaar acts as an intermediary. We do not guarantee the authenticity, condition, or delivery of any individual listing beyond the escrow and dispute mechanisms described above. Maximum liability for any claim is limited to the platform fee paid on the transaction in question. We are not liable for indirect, incidental, or consequential damages.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email and a banner on the Platform at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
